Trading Assistant Contract

This is for information purposes only.

Parties. The parties to this agreement are _________________________________________ representative for GOing1nceLLC and _________________________________________ , Client.

Purpose.
GOing1nceLLC will offer item(s) owned by Client for sale on ebay.

GOing1nceLLC Services.
The following services are provided by GOing1nceLLC to the Client:
Photography & web-hosting, write description, list on eBay, communicate with prospective bidders, receive payment from high bidder(s), package, ship, pay eBay and PayPal fees, pay Client when transaction is complete.

Term.
This agreement shall have a term of one year and may be terminated by either party by ten-day written notice to other party. Going1nceLLC will return to Client any unsold merchandise within 30 days of end of auction.

Right of Refusal.
Going1nceLLC may decline listing any Client item for any reason.

Ownership.
Client attest they have legal title to and are in legal possession of all items consigned to Going1nceLLC.

Sales Outside eBay.
If a price is offered via private offer prior to end of auction, Client will be contacted by Going1nceLLC to accept or decline such offer.

Possession.
Going1nceLLC will retain possession of Cleint item(s) unless otherwise noted on Consignment log. If item is unavailable to Going1nceLLC after sale has been made on eBay, Client will pay to Going1nceLLC double the commission.

Premature end of auction.
Client must notify Going1nceLLC by phone 24 hours prior to scheduled auction time if Client chooses to withdraw item from being listed on eBay. Any fees paid to Going1nceLLC will not be refunded. Client will pay a fee of $10 to Going1nceLLC upon return of such item to Client.
Once an auction is listed on eBay, the auction will run its full course and item must be sold to the highest bidder. If such an instance arises that the Client demands the auction(s) to be cancelled during its scheduled run on eBay, Client will pay to Going1nceLLC a cancellation fee of $100 upon return of item to Client.

Accounting.
Going1nceLLC will furnish report of sales and commissions and check to Client of proceeds of sale less any fees due to Going1nceLLC upon completion of transaction(s). This will generally occur fourteen to thirty days after the end of auction.

Loss or Damage.
Client shall keep any items consigned to Going1nceLLC fully insured while in possession of Going1nceLLC. Going1nceLLC will make every effort to safeguard consigned item(s) and will reimburse Client for damage caused by Going1nceLLC at average eBay sale price (during previous 3 months) less Going1nceLLC commission of item(s. However, items lost or damaged due to fire, theft, flood and other events beyond the control of Going1nceLLC will not be reimbursed by Going1nceLLC. Going1nceLLC will insure all shipments of items shipped to eBay buyers.
In the event that eBay and/or Going1nceLLC's host server or ISP experiences a power outage at any time during the auction, or upon disruption of auction beyond control of Going1nceLLC, Client will hold Going1nceLLC harmless.

Client Bidding.
Client will not bid directly or indirectly on item(s) consigned to Going1nceLLC. Client will inform his family and associates they are not to bid on these items either.

Returns.
Going1nceLLC allows buyers to return items for full refund if Going1nceLLC is notified within 3 days of buyer's receipt of item and ships return within an additional 3 days. Client will be contacted to approve relist of item or return to Client. Should Going1nceLLC choose to accept a returned item beyond this period, ownership of that item will be retained by Going1nceLLC which may relist on eBay or dispose in manner of Going1nceLLC's choosing.

Confidentiality.
Going1nceLLC and Client agree to confidentiality of mutual information and may release such information only with the written consent of each party.
